Terms & Conditions
Last updated: 18 October 2026
These terms and conditions apply to all services provided under the brand Elevra by A&K Worldwide Enterprises FZCO, Premises 407-FZH 220, Floor 04, Sheikh Rashid Tower, Dubai World Trade Centre, Dubai, United Arab Emirates (“Elevra”, “we”, “us”) to its clients (“Client”).
1. Scope
These terms apply to all contracts for marketing, advertising and consulting services between Elevra and the Client. Conflicting or deviating terms of the Client apply only if we have expressly agreed to them in writing. Individual agreements in a proposal, order or statement of work (“Proposal”) take precedence over these terms.
2. Business clients only
Our services are offered exclusively to businesses, freelancers and organisations acting in a commercial or professional capacity. We do not enter into contracts with consumers.
3. Proposals and conclusion of contract
Information on our website does not constitute a binding offer. A contract is concluded when the Client accepts our Proposal in writing or by email, or when we begin providing the services at the Client’s request. The scope of services, fees and term are defined in the Proposal.
4. Our services
We provide our services with due care and in line with recognised industry practice. Marketing results depend on many factors outside our control, such as product, pricing, market, competition, budget and the policies and algorithms of advertising platforms. We therefore owe the agreed services, not a specific economic result — in particular no guaranteed sales, leads, rankings or return on ad spend. Case studies and figures on our website describe past results and are no guarantee of future performance.
We may use qualified subcontractors and freelancers. We remain responsible to the Client for their work.
5. Client obligations
The Client provides all information, materials, approvals and access (e.g. to ad accounts, websites, analytics and stores) required to perform the services in good time. The Client is responsible for ensuring that its products, offers, claims and materials comply with applicable law and with the policies of the advertising platforms, and that it holds the necessary rights to all materials it provides. Delays caused by missing cooperation extend agreed deadlines accordingly.
6. Advertising budget and platforms
Unless agreed otherwise, advertising budgets are paid by the Client directly to the respective platform (e.g. Google, Meta) and are not part of our fees. Ad accounts should be held in the Client’s name. We are not liable for decisions of advertising platforms, such as rejected ads, account restrictions or suspensions, or changes to their services, unless caused by our own breach of duty.
7. Fees and payment
Fees are set out in the Proposal. Unless agreed otherwise, monthly fees are invoiced in advance and project fees according to the agreed milestones. Invoices are due within 14 days of the invoice date without deduction. All fees are exclusive of any applicable VAT or other taxes; for clients in the EU, the reverse-charge mechanism may apply. In case of late payment, we may suspend our services after a written reminder until payment is received.
8. Term and termination
The term and notice periods are set out in the Proposal. If nothing is agreed, ongoing services may be terminated by either party with 30 days’ notice to the end of a calendar month. The right to terminate for good cause remains unaffected. Notices must be given in writing; email is sufficient.
9. Approvals and changes
Campaign concepts, ad copy and creatives are presented to the Client for approval where agreed. Approved materials are deemed accepted. Changes to the agreed scope require a written agreement and may be charged separately.
10. Intellectual property
Upon full payment, the Client receives a non-exclusive, perpetual right to use the deliverables created specifically for the Client (such as ad copy and creatives) for its own business purposes. We retain all rights to our methods, know-how, templates, tools and pre-existing materials. Unless the Client objects, we may name the Client as a reference and present results in anonymised form.
11. Confidentiality
Both parties keep confidential all non-public information of the other party that they receive in connection with the cooperation, also after the end of the contract. This does not apply to information that is publicly known or must be disclosed by law.
12. Data protection
Where we process personal data on behalf of the Client, the parties will conclude a data processing agreement in accordance with Art. 28 GDPR. Information on how we process data on our website can be found in our Privacy Policy.
13. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body or health. In cases of slight negligence, we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract, at most to the amount of fees paid by the Client under the respective Proposal in the three months preceding the event giving rise to the claim. Liability for indirect damage, lost profit and lost data is excluded to the extent permitted by law.
14. Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, pandemics, war, government measures or outages of platforms and networks.
15. Use of this website
The content of this website is provided for general information. We do not guarantee that it is complete, accurate or up to date. External links lead to third-party websites for which their operators are responsible.
16. Governing law and jurisdiction
These terms and all contracts are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction, unless mandatory law provides otherwise.
17. Final provisions
Should any provision of these terms be invalid, the remaining provisions remain unaffected. We may amend these terms for future contracts. These terms are available in several languages; in case of discrepancies, the English version prevails.
